Bird Bam Mahjong Operated by Powder Hound Pet Company LLC ("Bird Bam," "we," "us," or "our")

These Terms of Use ("Terms") govern your use of the Bird Bam Mahjong mobile application (the "App") and the website birdbam.app (the "Site"). By creating an account or using the App or Site, you agree to these Terms. If you do not agree, please do not use the App.

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

Your Account
You are responsible for your account and for keeping your login credentials secure. You agree to provide accurate information and to notify us of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

Subscriptions, Free Trial, and Billing

‍Free trial. New users receive a 5-day free trial with full access to the App. No payment is required during the trial, and you will not be charged unless you choose to subscribe.

‍Social Membership. After the trial, continued access to premium features (including unlimited AI coaching with Bammie, unlimited daily games, and club creation) requires a paid Social Membership subscription at $12.00 USD per month (price may vary by region and is shown at purchase).

‍Auto-renewal. Subscriptions are billed through your Apple App Store or Google Play account and renew automatically each month unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

‍Canceling. You can manage or cancel your subscription at any time in your device's subscription settings (App Store: Settings → [your name] → Subscriptions; Google Play: Play Store → Payments & subscriptions). Deleting the App does not cancel your subscription.

‍Refunds. Payments are processed by Apple or Google, and refund requests are handled by them under their policies. We do not have the ability to issue refunds for purchases made through the app stores.

‍Free tier. Without a subscription, you can continue using free features of the App, which may include limited daily play, community browsing, and daily practice content. We may change what is included in the free tier over time.

AI Coaching Disclaimer

The App includes AI-powered coaching and practice features ("Bammie"). Bammie's responses are generated by artificial intelligence and are provided for practice, learning, and entertainment purposes. While we work to make Bammie accurate and consistent with National Mah Jongg League rules and conventions, AI-generated responses may occasionally be incorrect or incomplete, and we do not guarantee their accuracy. Bird Bam is not affiliated with or endorsed by the National Mah Jongg League. Official rules and the annual card are published by the NMJL, and nothing in the App replaces them.

Community Conduct

The App includes social features such as clubs, games, events, and messaging.
You agree not to:
-Harass, threaten, or demean other users
-Post content that is unlawful, obscene, hateful, or infringes anyone's rights
-Impersonate any person or misrepresent your affiliation
-Use the App for spam, advertising, or commercial solicitation without our permission
-Attempt to access other users' accounts or data
-Use bots, scripts, or automated means to access the App, or attempt to circumvent usage limits, subscription requirements, or security measures
-Reverse engineer, copy, or create derivative works of the App
-We may remove content or suspend or terminate accounts that violate these rules, at our discretion.

Your Content

You retain ownership of content you submit to the App (such as messages and profile information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and use it as needed to operate and improve the App.

Our Intellectual Property


The App, Site, and all related content — including the Bird Bam name, logo, designs, text, graphics, and software — are owned by Powder Hound Pet Company LLC or our licensors and are protected by intellectual property laws. Tile designs featured in the App may be the property of their respective licensors and are used under license. You may not use our trademarks or content without our prior written permission.

Third-Party Services

The App relies on third-party services (including Apple, Google, Firebase, RevenueCat, and Anthropic) and may link to third-party websites or products. We are not responsible for third-party services, and your use of them is governed by their own terms.

Disclaimers

THE APP AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWDER HOUND PET COMPANY LLC AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR SITE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Powder Hound Pet Company LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the App.

Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute terms) will survive.

Governing Law

These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.

Apple App Store Terms

If you downloaded the App from Apple's App Store, you acknowledge that these Terms are between you and Powder Hound Pet Company LLC, not Apple; Apple has no obligation to provide maintenance or support for the App; and Apple is a third-party beneficiary of these Terms with the right to enforce them.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date, and for material changes we will provide notice in the App or by email. Continued use of the App after changes take effect constitutes acceptance.
